Aviation Law

Home/Practice Areas

Fueled by technological progress and globalization, the aviation sector is a rapidly expanding, dynamic, and international industry. This environment gives rise to complex legal frameworks at both domestic and international levels.

At Can Law Firm, we offer legal advisory and representation services to stakeholders in this multifaceted field. Our work covers matters ranging from aircraft accidents and aircraft financing transactions to air cargo carriage and flight crew employment issues.

Aviation Accidents

Air transportation is one of the safest modes of travel. Therefore, accidents are rare. However, when an accident does occur, unfortunately, it often results in a significant number of fatalities or injuries.

Most aircraft accidents occur as a result of a combination of multiple factors, each with its own unique circumstances. For this reason, the cause of the accident must be thoroughly investigated, and the legal process must be managed with great care.

Depending on the cause of the accident, the liability of the carrier, manufacturer, or other entities may arise  and legal proceedings may be initiated in different jurisdictions.

Nazlı Can, the founder of Can Law Firm, graduated from the International Institute of Air and Space Law at Leiden University in 2011 with her thesis titled ‘A Legal Examination of Aircraft Accidents: A Comparative Study with Turkish Legislation.’ Since completing her studies, she has represented numerous aviation accident victims in Türkiye and abroad.

Air Cargo Carriage

The Turkish air cargo market reached approximately USD 4.15 billion in 2024. According to some sources, a compound annual growth rate (CAGR) of 5.52% is expected for the period between 2025 and 2033.

In this rapidly expanding and dynamic sector, a strong legal infrastructure is vital to ensure safe and uninterrupted transportation.

As Can Law Firm, we provide support to air cargo companies in the preparation of carriage contracts and in managing legal processes related to cargo damage, delay, or loss during transportation.

Aircraft Financing

Aircraft acquisition, sale, and leasing transactions are complex legal processes involving high financial value and requiring strict compliance with both domestic and international regulations. Can Law Firm provides legal support to clients in all matters related to the purchase, transfer, and lease of aircraft.

Our services cover every stage of these transactions, including the drafting and negotiation of sale and lease agreements, as well as the registration  procedures with the relevant authorities. In addition, we represent our clients in potential disputes before judicial bodies and alternative dispute resolution mechanisms.

Disputes Related to Passenger Rights

In 2024, the number of passengers using airports in Türkiye exceeded 230 million and continues to grow steadily. While the majority of these journeys are completed without issues, there are also flights affected by delays, cancellations, and denied boarding.

As Can Law Firm, we provide support to passengers in matters related to flight delays, cancellations, and denied boarding, in accordance with national and international civil aviation regulations.

Disputes Involving Flight Crew Members

In the aviation sector, flight crew members are excluded from the scope of the Turkish Labor Law No. 4857 and, with certain exceptions, are subject to the Turkish Code of Obligations.
As Can Law Firm, we provide legal consultancy to flight crew members in the negotiation and drafting of employment contracts and flight training agreements, and we also represent our clients in potential disputes arising in this context.
